My tenant has asked for their claim to be backdated, which LHA rate will apply.

If the claim is before the 7th April 2008 then the claim is regarded as being before the Local Housing Allowance regulations came into force. If the date is after 7th April 2008 their LHA rate will be based on the LHA rate for the month in which the claim starts.
