Claims against the council

All claims for compensation as a result of alleged neglect by the Council or its employees are dealt with by the insurance section.

There is no automatic entitlement to compensation for injuries or property damage following an incident in or on property owned by Rochdale Borough Council. A number of factors have to be considered to establish whether the Council has been negligent and are legally liable. All claims will be fully investigated.

The insurance section’s task is to ensure that all Council assets are adequately and effectively insured to cover the Council’s legal liability in the event of a claim.

Claim compensation

If you wish a claim for compensation to be considered by the Council’s you will need to provide the following details in writing to Insurance and Risk Management (the address is given in the top right hand side of your screen):

  • Your name, address, telephone number and date of birth
  • Where the incident occurred, giving as much information as possible to assist in the identification of the specific location
  • Time and date of when the incident happened
  • The nature of your injuries or details of property damaged
  • Why you believe the Council is responsible

Legal requirements

In order to comply with legal requirements and follow legal protocol, claims for compensation are unable to be accepted via electronic communication (the internet or email).

Detection of Fraud

In order to protect the public funds we handle we aim to detect and prevent fraud. Rochdale Borough Council may make use of the information that you supply as part of ongoing efforts in the detection and prevention of fraud. For the same purposes Rochdale Council may release details of your claim to organisations which also have a duty to protect public funds.
